Amendments to the Decree on Special Conditions for the Trade in Certain Types of Goods

We recall that in 2025 the Government adopted the Decree on Special Conditions for the Trade in Certain Types of Goods (“Official Gazette of the RS”, No. 76/25, hereinafter: the “Decree”), which introduced special rules for traders and suppliers of certain goods, particularly in respect of trade discounts, fees, and the method of price formation. The Decree has been in force since 1 September 2025 and shall apply for a period of six months from the date of its commencement.

In the meantime, the Decree has been amended and supplemented, with the amendments and supplements published in the “Official Gazette of the RS”, No. 78/25, and effective as of 13 September 2025. These amendments further specify the relations between traders and suppliers, especially with regard to the limitation of margins and fees, as well as transparency in price formation.

Key changes?

  • Special payment deadlines – The limitation of the payment deadline of 60 days does not apply to the trade in fresh fruit and vegetables, fresh meat and fish, as well as to commodities traded on exchanges (coffee and cocoa);
  • Limitation of margins – The limitation of the maximum margin of 20% shall now be calculated from the date of the first placing of goods on the market of the Republic of Serbia, thereby clarifying the starting point for the application of this restriction;
  • Fees and rebates – Where fees, logistic rebates or fees for shortages/write-offs were lower on 1 August 2025, they may not be increased. Traders who had not agreed upon such fees by that date may include them in the calculation of the retail margin, up to the permitted amount prescribed under the Decree;
  • Price list transparency – Price lists must now also include the bar code of the product. Furthermore, price lists are required to be submitted in electronic format, and the Ministry of Internal and External Trade shall publish them on its official website.
