The Government of the Republic of Serbia has adopted the Decree Amending and Supplementing the Decree on Special Conditions for the Conduct of Trade in Certain Types of Goods, introducing additional rules on margin and price limitations, relations between traders and suppliers, as well as the obligation to publish price lists on the Open Data Portal.
Key Amendments:
Margin and Invoice Price Restrictions
- The maximum retail margin remains 20% (calculated on the sales price exclusive of VAT).
- The margin cap applies to both regular and promotional prices.
- The list of products for which the invoiced price may deviate from the price applicable on 1 August 2025 is expanded to include: tea, frozen fruit, and honey (in addition to fresh fruit and vegetables, eggs, fresh meat, fresh fish, coffee, cocoa).
Fees Charged by Traders to Suppliers
- The total amount of fees may not exceed 10% of the total net invoice value.
- For suppliers who have installed freezers at the trader’s premises, the limit is 18% of the total net invoice value.
- The logistics rebate and shortage/write-off fees may not exceed the amounts agreed as of 1 August 2025.
- If previously agreed fees were lower on that date, they may not be increased.
- Traders who had no previously agreed fees may include, when calculating the retail margin, an allowed amount of up to 14%.
- Promotional rebates must be fully transferred to the retail price.
- Accounting documents must clearly state the purpose of payment.
- Retail traders are required to conclude contract amendments with suppliers for alignment with the Decree.
Supply and Ordering Amendments
- Deletion of products from the contractual assortment or significant reduction of orders is permitted only with the supplier’s written consent.
Obligation to Publish Price Lists and Public Access
- Traders must publish price lists applicable on 1 April, 1 August, 31 August, and 1 September 2025 via their account on the Open Data Portal.
- Price lists must be published in CSV format, in accordance with the technical specifications of the Ministry of Trade.
- The obligation also applies to price lists previously submitted on Mondays.
- All price lists will be publicly available as of 9 December 2025 on the website of the Ministry of Trade and the Open Data Portal.
The Decree enters into force the day following its publication in the Official Gazette, while the provisions relating to price lists apply as of 1 December 2025.
