New Law on Recording and Registration of Property Rights

In the Official Gazette of the Republic of Serbia, No. 91 of 23 October 2025, the Law on Special Conditions for the Recording and Registration of Property Rights (the “Law”) was published, introducing a comprehensive legal framework for the recording and registration of ownership rights to buildings and the land beneath them.

The Law includes buildings constructed without a building permit, buildings covered by previous legalization laws, as well as infrastructural and auxiliary facilities.

Upon the entry into force of the new Law, the previous Law on the Legalization of Buildings (Official Gazette of the RS, Nos. 96/15, 83/18, 81/20 – CC, 1/23 – CC and 62/23*) shall cease to apply, and all pending legalization procedures shall be terminated.

In the real estate cadastre and the infrastructure cadastre, in addition to ownership rights and other related rights, a notation shall be entered stating that the ownership right to the building, part of the building, or a separate part of the building has been registered on the basis of this Law, as well as other notations, in accordance with the provisions of the Law.

Method of submission of applications:

The Law introduces a digital platform managed by the Agency for Spatial Planning and Urbanism of the Republic of Serbia (the “Agency”), in cooperation with the Republic Geodetic Authority.

The application shall be submitted electronically, through the Agency’s digital platform, for each property separately.

Procedure and competence:

The procedure for recording property shall be conducted exclusively electronically, through the digital platform, without construction documentation, and within an expedited time frame. The Agency shall verify the documentation and determine whether the building meets the conditions for recording. If the conditions are met, the Agency shall issue a certificate of recording which has the legal effect of a public enforceable document.

Based on that certificate, the Republic Geodetic Authority shall register the ownership right in the real estate cadastre. If the conditions are not met, the Agency shall, without delay, notify the applicant and the competent construction inspector electronically.

Fee:

The fee for recording costs shall be determined according to the zone, type, and area of the building. Certain categories of persons — such as socially vulnerable citizens, families with three or more children, and persons with disabilities — may be exempted from payment.

Deadlines:

The deadline for submitting the application begins upon the expiration of 45 days from the date of entry into force of the Law and lasts 60 days. Exceptionally, persons who, for objective reasons, fail to submit the application within that period may do so within one year from the date of entry into force of the Law, provided that they submit evidence clearly establishing the justification for the failure to submit the application.
